TOUR PARTICIPATION WAIVER & RELEASE OF LIABILITY
PLEASE READ CAREFULLY — THIS IS A LEGALLY BINDING DOCUMENT
This Waiver and Release of Liability Agreement is entered into by the undersigned participant (“Participant”) in favor of Wildland Expeditions and Tours.
1. ASSUMPTION OF RISK
I understand and acknowledge that participation in guided wildlife, outdoor, and backcountry tours involves inherent and unavoidable risks, including but not limited to: encounters with wild animals, including large and potentially dangerous wildlife, unpredictable animal behavior, uneven terrain, steep trails, loose rock, mud, snow, ice, water crossings, and vegetation, changing and severe weather conditions including wind, heat, cold, rain, snow, and lightning, vehicle travel on paved, gravel, and unimproved roads, physical exertion, fatigue, dehydration, altitude exposure, and injury and limited or delayed access to emergency medical services in remote locations. I voluntarily and knowingly assume all risks, both known and unknown, associated with participation in Company activities.
2. RELEASE OF LIABILITY (MONTANA)
To the fullest extent permitted by Montana law, I hereby release, waive, and discharge the Company, its owners, employees, guides, contractors, volunteers, affiliates, land managers, and permitting agencies from any and all claims, demands, causes of action, or liability arising from injury, illness, loss, damage, or death related to my participation, including claims arising from negligence, except where prohibited by law.
3. INDEMNIFICATION
I agree to indemnify and hold harmless the Company from any claims, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of my participation or my actions during the tour.
4. VEHICLE TRANSPORTATION ACKNOWLEDGMENT
I acknowledge that the tour may involve transportation in Company-owned or operated vehicles, or caravan travel in personal vehicles. I understand that road travel carries inherent risks including accidents, road conditions, wildlife collisions, and weather hazards.
I voluntarily assume all risks associated with vehicle transportation and release the Company from liability related to transportation to the extent permitted by Montana law.
5. MEDICAL RESPONSIBILITY & EMERGENCY CARE
I certify that I am physically capable of participating in this tour and have disclosed any relevant medical conditions. I understand that the Company does not provide medical insurance.
I authorize the Company to obtain emergency medical treatment on my behalf if deemed necessary. I accept full financial responsibility for all medical care, evacuation, or rescue expenses incurred.
6. MULTI-DAY & BACKCOUNTRY ACKNOWLEDGMENT
I understand that multi-day and backcountry tours may take place in remote areas where emergency response times may be delayed or unavailable. Evacuation may require significant time due to terrain, weather, or access limitations.
I accept these risks and acknowledge that early departure, itinerary changes, or missed tour components do not constitute grounds for refunds beyond what is stated in the Company’s cancellation policies.
7. COMPLIANCE WITH GUIDE INSTRUCTIONS
I agree to follow all instructions provided by Company guides and staff. Failure to comply with safety instructions, wildlife regulations, or guide direction may result in immediate removal from the tour without refund.
8. PARK, LAND & PERMIT ACKNOWLEDGMENT
I acknowledge that tours may operate on lands managed by the National Park Service, Montana state agencies, tribal lands, or other public or private land managers.
I agree to follow all applicable laws, regulations, permit conditions, wildlife protections, and land-use rules. I understand that permitting agencies assume no liability for my participation.
9. WILDLIFE DISCLAIMER
I understand that wildlife sightings are not guaranteed. Wildlife behavior is unpredictable, and no refunds will be issued due to the absence of wildlife or specific species.
10. WEATHER, ITINERARY & CANCELLATION POLICY ALIGNMENT
I understand that weather, road conditions, wildlife activity, or safety concerns may require changes to the itinerary or cancellation of a tour.
I acknowledge that I have read and agree to the Company’s Cancellation Policy, including refund timelines and conditions. I understand that cancellations, early departures, or missed activities are governed strictly by that policy.
11. PHOTOGRAPHY & MEDIA RELEASE (OPTIONAL)
I grant permission for the Company to use photographs or video taken during the tour for promotional or educational purposes without compensation, unless I notify the Company in writing prior to the tour.
12. MINORS (UNDER 18 YEARS OF AGE)
If the participant is under 18 years of age, this waiver must be signed by a parent or legal guardian.
I certify that I am the parent or legal guardian of the minor listed below and consent to their participation. I agree to all terms of this Agreement on behalf of myself and the minor.

13. GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by the laws of the State of Montana. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
14. ACKNOWLEDGMENT & SIGNATURE
I acknowledge that I have read and fully understand this Agreement, that I am signing it voluntarily, and that I am giving up certain legal rights.
